Terms of Service
These Terms of Service ("Terms") are an agreement between you and Little App OÜ ("Loomi", "we", "us", or "our") that governs your use of the Loomi mobile app and related services (the "Service"). Please read them carefully. By downloading, accessing, or using Loomi, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 17 years old (or the age of majority in your jurisdiction, if higher) to use Loomi, because the Service includes mature relationship and intimacy content. By using the Service, you represent that you meet this requirement and that you are able to form a binding contract with us.
2. Your account and pairing
You sign in with Apple to create an account. You are responsible for maintaining the security of your device and account and for all activity that happens under it. Loomi lets you connect with a partner to share content and progress; if you pair with someone, you understand that certain information will be shared with them as described in our Privacy Policy. Only pair with a partner you trust, and share only what you are comfortable sharing.
3. License to use Loomi
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service for your own non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service, or attempt to access it in ways we do not intend, except where such restrictions are prohibited by law.
4. Subscriptions, billing, and free trials
- Loomi may offer paid subscriptions that unlock additional features. Subscriptions are sold and processed by Apple through your App Store account.
- Unless auto-renew is turned off at least 24 hours before the end of the current period, your subscription automatically renews and your Apple account is charged the then-current price for the next period.
- You can manage or cancel your subscription any time in your Apple ID settings. Deleting the app does not cancel a subscription.
- If we offer a free trial, any unused portion is forfeited when you purchase a subscription, where applicable.
- Payments are final and non-refundable except where required by law or by Apple's applicable policies. Refund requests for App Store purchases are handled by Apple.
- Prices and plans may change; we will give notice of changes as required, and changes will not affect a billing period already paid for.
5. Your Content
You own what you create in Loomi. Your memories, photos, notes, drawings, answers and anything else you add ("Your Content") belong to you, and we do not claim ownership of them.
So that we can run the app, you grant us a limited, worldwide, royalty-free, non-exclusive licence to host, store, copy, reproduce, transmit and display Your Content for the sole purpose of operating and providing the Service to you and, where you have paired, to your partner — including saving it, syncing it across your devices, and backing it up.
We do not use Your Content to advertise or promote anything, and we do not share it with anyone except as described in our Privacy Policy.
This licence ends when you delete Your Content or your account, except for copies retained in routine backups for a limited period.
You are responsible for Your Content, and you confirm that you have the right to share it and that it does not violate the law or anyone else's rights.
6. Acceptable use
When using Loomi, you agree not to:
- Use the Service for any unlawful, harmful, harassing, or abusive purpose;
- Upload content that is illegal, infringing, or that you do not have the right to share, including another person's private information or images without their consent;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Use the Service to build or train a competing product, or scrape or harvest data from it.
7. Intellectual property
The Service, including its software, design, text, graphics, illustrations, and the Loomi name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license granted to you above, these Terms do not give you any rights in our intellectual property.
8. Safety and Emergencies
Loomi is an educational app about relationships. It is not a crisis service and it cannot help in an emergency. If you or someone else is in immediate danger, contact your local emergency number straight away.
Loomi is not designed for, and must not be relied on in, situations involving abuse, violence, coercion or control. Its lessons assume two people who are both safe and free to speak openly with each other. If that does not describe your situation, please seek help from a qualified professional or from a domestic abuse support service in your country.
Nothing in Loomi is medical, psychological, psychiatric or therapeutic care, and it is not a substitute for professional advice, diagnosis or treatment. Never disregard professional advice, or delay seeking it, because of something you have read in Loomi.
9. Third-party services
The Service depends on third parties such as Apple and our hosting and subscription providers. Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any result or outcome will be achieved. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Loomi and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty U.S. dollars ($50).
12. Indemnification
You agree to indemnify and hold harmless Loomi and its owners, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal or security reasons. Sections that by their nature should survive termination — including content licenses you have granted, disclaimers, limitations of liability, and indemnification — will survive.
14. Changes to the Service and these Terms
We may update the Service and these Terms from time to time. When changes are material, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
15. Apple
These Terms are between you and Little App OÜ only, and not with Apple Inc. ("Apple"). Apple is not responsible for Loomi or its content.
Apple has no obligation to furnish any maintenance or support services for Loomi.
If Loomi fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Loomi.
Little App OÜ, and not Apple, is responsible for addressing any claim by you or any third party relating to Loomi or your possession and use of it, including product liability claims, any claim that Loomi fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Little App OÜ, and not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that Loomi, or your possession and use of it, infringes that third party's intellectual property rights.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary of them.
16. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to its conflict-of-laws rules. You and we agree to submit to the jurisdiction of the competent courts of Estonia, unless applicable law requires otherwise. Nothing here limits any mandatory consumer-protection rights you have where you live.
17. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
